Terms of Service

1. Eligibility & Your Account

You must be at least 18 years old and capable of forming a legally binding contract under the Indian Contract Act, 1872 (or the equivalent law of your jurisdiction) to create an account.

You agree to provide accurate, current, and complete information when you register and to keep that information up to date. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us at security@astropal.com immediately if you suspect unauthorised access.

2. Description of the Service

AstroPal is an AI-powered Vedic astrology platform. We use proprietary technology trained on a mixture of licensed data, expert-curated knowledge, and publicly available astrological texts to generate personalised responses, charts, reports, and chats.

AstroPal does not onboard, employ, or partner with human astrologers. Every reading, prediction, chat reply, and report on the Service is produced by AI - not by a person. There is no live astrologer behind any feature of the Service.

All outputs are automated, probabilistic, and non-deterministic. Different users may receive different outputs for similar inputs, and the same input may produce different outputs at different times.

3. AI & Astrology Disclaimer (Critical)

You acknowledge and agree that:

• AstroPal's responses are generated by AI. AI can and does make mistakes. Outputs may be inaccurate, incomplete, outdated, misleading, biased, fabricated ("hallucinated"), or simply wrong
• Astrology is a belief-based and interpretive system. AstroPal does not claim astrology to be scientifically proven
• No prediction, insight, score, remedy, interpretation, or chart produced by the Service is guaranteed to be accurate or to come true
• You must use your own judgment and take your own precautions before acting on anything the Service produces
• AstroPal makes no representations or warranties about the accuracy, completeness, fitness, timeliness, or real-world outcomes of any output

The Service is provided for general informational and entertainment purposes only. You are solely responsible for how you interpret and act on it.

4. No Professional Advice

AstroPal is not a substitute for a qualified professional. The Service does not provide and must not be relied on for:

• Medical, psychiatric, psychological, or mental-health advice, diagnosis, or treatment
• Legal advice or legal services
• Financial, investment, tax, accounting, gambling, or trading advice
• Marital, divorce, custody, fertility, pregnancy, or family-planning decisions
• Religious or spiritual instruction
• Career or employment decisions of consequence

Always consult an appropriately qualified, licensed professional before making any decision that could affect your health, safety, finances, relationships, or legal position.

5. Crisis & Emergency Notice

AstroPal is not designed for emergencies and is not a crisis service. If you are in a crisis, having thoughts of harming yourself or someone else, in a medical emergency, or in immediate danger, please stop using the Service and contact local emergency services right away. In India, you can call 112 for emergencies, or reach iCall (9152987821) or AASRA (+91-9820466726) for mental-health support.

The Service must not be used by anyone in active crisis as a substitute for professional help.

6. User Responsibility

You are solely responsible for:

• The accuracy of the birth details and other information you provide
• How you interpret and use any output of the Service
• Any decision or action you take based on the Service - the Service is informational only and you take your own precautions
• Maintaining the security of your account and devices
• Ensuring your use of the Service complies with the laws of your jurisdiction

Your use of AstroPal is entirely at your own risk.

7. Prohibited Use

You agree that you will not:

• Use the Service in connection with self-harm or suicide ideation, or to encourage harm to yourself or others
• Treat the Service as a substitute for professional medical, legal, financial, or psychological advice
• Use the Service for any illegal, abusive, harassing, defamatory, obscene, hateful, or fraudulent purpose
• Upload, generate, or distribute content that is unlawful, infringing, sexually explicit, violent, exploitative of minors, or that promotes terrorism, hatred, or violence
• Attempt to reverse engineer, decompile, scrape, mirror, frame, or otherwise misuse the Service or our proprietary systems
• Use AstroPal outputs to train, fine-tune, or evaluate any competing AI or astrology model, or to build a competing product
• Resell, sublicense, or commercially exploit the Service or its outputs without our prior written consent
• Probe, scan, or test the vulnerability of the Service, breach security or authentication, or interfere with other users
• Use any automated means (bots, crawlers, scripts) to access the Service except as we expressly permit
• Engage with the Service in any way connected to black magic, witchcraft, voodoo, or harmful occult practices

We may suspend or terminate access at any time, without notice, if we believe you have violated this section.

8. Credits, Payments & Refunds

Certain features of the Service are paid and use an in-app credits system.

• Prices, credit packs, and feature costs are shown in the app at the time of purchase and may change from time to time
• Payments are processed by third-party payment gateways. We do not store your card or UPI details
• Credits are notional units used to access features. Credits have no cash value, are non-transferable, and cannot be exchanged for cash
• Promotional, bonus, or referral credits may carry shorter validity and may expire as stated at the time they are granted
• Once a report or insight has been generated and delivered to you, the corresponding credits are consumed and are not refundable. If a feature fails to deliver due to a genuine technical fault on our side, we will refund the consumed credits to your account
• If your account is suspended or terminated for breach of these Terms, any unused promotional credits will lapse immediately and paid credits may be forfeited

Refund requests must be raised within 7 days of the transaction by emailing support@astropal.com. We review each request on its merits and our decision is final.

9. User-Generated Content

You retain ownership of the content you submit to the Service (such as questions you ask the AI, feedback, or profile data).

By submitting content, you grant AstroPal a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process that content for the purpose of operating, securing, and improving the Service, in accordance with our Privacy Policy.

You represent that you have the right to submit any content you provide and that it does not violate the rights of any third party.

10. Intellectual Property

All content, designs, algorithms, scoring systems, models, features, branding, logos, and generated outputs (other than your own user-generated content) are the exclusive intellectual property of AstroPal or its licensors. You may not:

• Copy, redistribute, mirror, or resell the Service or any substantial part of it
• Claim ownership of our frameworks, prompts, scoring systems, or models
• Use any output of the Service to build, train, fine-tune, or evaluate a competing product or model

You may use outputs the Service generates for you for your own personal, non-commercial use only.

11. Data Use & Privacy

Our Privacy Policy explains what we collect, how we use it, and the choices you have. By using the Service you agree to the practices described there. The Privacy Policy is incorporated into these Terms by reference.

12. Service Availability & Modifications

We are constantly improving AstroPal. We may, at any time and without notice:

• Add, modify, or discontinue features
• Adjust pricing or credit costs
• Restrict or rate-limit access
• Update our AI models or underlying logic
• Perform maintenance that temporarily makes the Service unavailable

We do not guarantee uptime, availability, or continuity of any feature.

13. Suspension & Termination

We may suspend or terminate your access immediately, with or without notice, if:

• You breach these Terms, the Privacy Policy, or any law
• We believe your use poses a legal, security, financial, or safety risk
• We are required to do so by law, regulator, or court order
• You have been inactive for a long period or your account is dormant

You may stop using and delete your account at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, intellectual property, and governing law) will survive.

14. Warranty Disclaimer

The Service, and all content and output produced by it, are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express, implied, or statutory. To the maximum extent permitted by law, AstroPal disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that outputs will be accurate, reliable, complete, current, or meet your expectations. The Service is provided for entertainment and general informational purposes only.

15. Limitation of Liability

To the maximum extent permitted by law, AstroPal, its affiliates, officers, employees, and suppliers shall not be liable for:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, revenue, data, opportunity, goodwill, or anticipated savings
• Emotional distress, anxiety, disappointment, or personal dissatisfaction
• Any decision or action you take, or fail to take, based on any output of the Service
• Any conduct of any third party, including third-party services, payment gateways, or AI model providers

If, despite the above, AstroPal is found liable to you for any matter arising out of or relating to these Terms or the Service, our aggregate liability shall not exceed the greater of (a) the total amount you paid to AstroPal in the 12 months preceding the event giving rise to the claim, or (b) INR 1,000.

16. Indemnification

You agree to indemnify, defend, and hold harmless AstroPal, its affiliates, and their respective officers, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use or misuse of the Service
• Your reliance on, or any decision you make based on, any output of the Service
• Your violation of these Terms, the Privacy Policy, or any applicable law
• Your violation of any third-party right, including any intellectual property or privacy right

17. Third-Party Services

The Service may rely on or link to third-party services, including payment gateways, authentication providers, hosting providers, and AI model providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the acts, omissions, content, or policies of any third party.

18. Force Majeure

AstroPal is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, government action, pandemics, war, terrorism, civil unrest, internet or telecommunications failures, denial-of-service attacks, or outages of third-party services on which we rely.

19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Bathinda, Punjab, India. The language shall be English. The award shall be final and binding.

Subject to the arbitration clause, the courts at Bathinda, Punjab, India shall have exclusive jurisdiction over any matter requiring interim or injunctive relief.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last Updated" date above and, where appropriate, notify you by email or in-app notice. Your continued use of the Service after the update means you accept the revised Terms. If you do not agree, you must stop using the Service.

21. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AstroPal regarding the Service and supersede all prior or contemporaneous communications.
